City guard, abstract suspicious attitude and generic exploratory magazines in criminal investigation – a necessary reflection

Abstract

In a social context where issues related to public safety have been widely discussed, there is a need to analyze the limits of competence and police power of the Municipal Guard. To this end, the attributions of the Municipal Guards in Brazil were described and presented, who have constantly adopted the traditional model of policing typical of the Brazilian state police, translated by notions of war on crime and combating criminal.The justification of the work is related under the assumption that the Municipal Guards must move away from these flawed traditional models of confrontation, especially with regard to combating the ostensible practice in the abstract suspicious attitude, should be presented in the community policing model, guided by ideals of proximity and interaction with the population, and focused on conflict resolution and promotion of safe environments. The general objective of this research will be to define the limits imposed by the federal constitution on the role of the Municipal Guard in the face of this new scenario of Public Security, how one should seek to remove the ostensible and generic role of the Municipal Guard in criminal investigation. At the end, concludes that the Municipal Guards have been contributing to increase the sense of security of citizens, however it follows a different path to its competences and functions, being several times active in an unregulated exercise for his position.
