Abstract

The advances of Brazil as a democracy are undeniable, especially after the promulgation of the Federal Constitution of 1988, and the prediction of human dignity as one of the pillars of this new State. Despite the challenges of the still recent Brazilian democracy, it is undeniable that the power-duty existing in the Brazilian State requires attention to the needs and desires of its citizens, allowing their development and respecting social rights such as the right to education, health, food, to work, housing, transport, leisure, security, social security, maternity and childhood protection, and assistance to the destitute. These rights must be added to economic development issues with the reduction of intervention and bureaucratization of this new Democratic State of Law, with a view to stimulating those who inhabit this soil. We have recently had notes from a study of legal sciences with strict guidelines in rule of principles, and, therefore, a new analysis of Law as a social truth is necessary that aims to meet the aspirations of members of society in the Neoliberal State of Law, which go beyond the mere expectation of satisfaction of physiological needs, especially when we consider elements of Herzberg's theory, and this motivates the members of organized society, being, therefore, crucial points for the development of the dignity of the human person.
