The work "Captains of the Sand" by Jorge Amado and the Statute of the Child and Adolescent: an Analysis between Law and Literature

Abstract

The objective of this study is to analyze the book "Capitães da Areia" by Jorge Amado from the Statute of the Child and Adolescent, focusing on the situation experienced by the minors portrayed in the work and how the ECA/1990 analyzes the theme in the current scenario of Brazil. Recent research in the legal area points out that the relationship between Law and Literature can generate important reflections, as it allows us to analyze society and its many legal problems. Thus, works of classical literature can reveal the legal phenomena that were happening at the time the text was written. Thus, in this work we sought to carry out a literature review of the work "Capitães da Areia" by Jorge Amado with the objective of understanding what the life of children and adolescents was like at the time the work was written, taking into account their fundamental rights, custody, guardianship and adoption, as well as infractions, socio-educational measures and rates of violence against children and adolescents in Brazil. The method used is the historical with a qualitative approach, through the explanatory level using the bibliographic research technique. In addition, quantitative research was carried out with the analysis of data from Dial 100 that deals with violence against children and adolescents. The results found were that, in fact, there are countless cases involving the curtailment of the rights of children and adolescents, with a family, social, and governmental slowness in guaranteeing these. making them more conducive to life on the streets, at the mercy of constant dangers and very high crime rates.
