Case Law Analysis of the Regional Labor Court of the 13th Region regarding Burnout Syndrome

Abstract

This article aims to analyze the presence and treatment of Burnout Syndrome in the case law of the Regional Labor Court of the 13th Region, based on an interdisciplinary approach combining Labor Law and Legal Psychology. The choice of this topic is justified by the growing relevance of mental disorders resulting from working conditions, especially in a scenario of intensifying work pace and ever-increasing demands on professional performance. The research seeks to understand not only the concept of the syndrome and its implications in the workplace, but also how the Labor Judiciary has addressed these demands. To this end, a qualitative methodology with an explanatory level was used, through a bibliographic and documentary survey, particularly the analysis of decisions published on the TRT-13 website. The data showed that the term "Burnout" was mentioned 243 times in the decisions, with only seven of these mentions found in the summary judgments. Of these seven decisions, only three recognized a causal link between the work performed and the development of the syndrome. Therefore, it can be concluded that despite the recurrence of the topic in court decisions, there is still a timid approach in the judgments that effectively address the issue in a substantial manner. This study contributes to the debate about the importance of mental health in labor relations and the legal recognition of this type of illness.
